Kim Potter has been found guilty of Manslaughter in the first and second degree for the shooting death of Daunte Wright. Each of these criminal acts require reckless behavior, and I do not believe this was shown at trial. Rather, it appears the prosecutors under Attorney General Keith Ellison conflated negligence with recklessness to confuse the jury. It appears to have worked.
Here is why this is the incorrect verdict as a matter of law.
