Matt: I kind of touched on this but did you see that the six-point plan advanced by trump lawyer John Eastman for VP Pence to overturn the election was released. Pretty interesting reading. Sam: Yeah it doesn't look like and and and you made the point on Twitter matt that this was like this was not this is not a question of like are you kidding me I would never you know the plot to overthrow the outcome of an election. No, it was more just like what's the risk-reward here? I mean can we get away with this? Matt: We already got quite a lot of good off from trump. Maybe we should make a getaway. Sam: This I mean and let's be clear here this six-point plan they didn't throw this away somebody has kept it in their files. Point one pence could preside over the joint session and begins to open and count the ballots starting with Alabama and going through the states alphabetically if required. When he gets to Arizona he announces that he has multiple slates of electors and is so gonna defer a decision on that until finishing the other states. This would be the first break with the procedure set out in the act. this is trump's lawyer incidentally. Matt: It's interesting that those sorts of lines are very interesting like letting you know exactly where you're crossing the lines. Sam: Exactly at the end he announces that because of the ongoing disputes in the seven states there are no electors that can be deemed validly appointed to those states. That means the total number of elected electors appointed in the language of the 12th amendment it's 454.
