SAN FRANCISCO - A 57-year-old San Francisco police sergeant has been sentenced to a term in jail after pleading no contest to felony charges for robbing a Rite Aid pharmacy in San Mateo of painkillers last year. Davin Cole entered the no-contest plea in September to two counts of robbery with an enhancement for being armed during the theft at the pharmacy on Concar Drive on Nov. 3, 2021, according to the San Mateo County District Attorney's Office. On Wednesday, Cole received a sentence of nearly a year in county jail that can be served in a residential treatment program after he serves 130 days in jail. San Mateo County Superior Court Judge Elizabeth Hill also sentenced him to three years' probation and to pay various fines and fees. Prosecutors had asked the judge to impose a state prison sentence. According to the District Attorney's Office, Cole had walked into the pharmacy and handed an employee a note that said he had a gun and to give him Norco opioid pills. Police Officer Suspected In Evidence Theft And Gang Ties A former Rocky Ford Police Officer was arrested Tuesday for allegedly stealing guns and prescription drugs from cases where he worked. Now, his romantic partner is accusing him of being part of a gang. In June 2022, former officer George Ibarra responded to a domestic case as an officer with the Rocky Ford Police Department. According to court documents, the suspect, Nicholas Kekoa Smith, was arrested and charged with illegally discharging a firearm. After the arrest, Ibarra confiscated a gun, but according to body camera video from that case, he also took the victim’s backpack with a 9mm gun, a gun holster, ammunition, prescription drugs, and other miscellaneous items, and placed it in his police car. About six months after the incident, the victim of the domestic case called the police department asking for her backpack and items back. According to arrest documents, the police chief said he couldn’t find them. The victim filed a police report with the Otero County Sheriff’s Office, which referred the case to the Colorado Bureau of Investigations due to a conflict of interest. During the investigation, Rocky Ford Police Chief Sean McDonagh told investigators a gun in another case involving Ibarra was also missing.
