The central issue in front of the Court was whether a defendant has a defense under ORS 162.247(1) when he peacefully and passively resists an officer’s lawful order, regardless of the reasons for refusing to obey. The law allows a jury to acquit a defendant charged with interfering with a peace officer if the defendant “is engaging in … passive resistance.” ORS 162.247.
The State’s argument rested primarily on the legislature’s reason behind enacting the statutory defense for passive resistance. The State argued that the law was originally intended to protect government protesters—traditionally related to social activism or other political movements—and that a person who peacefully and passively resists cooperation with police in a setting outside of those bounds is not protected by the law. The Court disagreed, giving all citizens more leeway to peacefully refuse to cooperate with police.
