DNA Backlogs: Case delays due to forensic neglect are human rights violation – Action Society
Liezel de Jager, Mia Botha, Cleo Diko, Chevonne Rusch and Alfredo April’s murderers all occurred more than 200 days ago and in all of their cases, forensic neglect caused the wheels of justice to stall. Action Society has now followed up with the Office of the Public Service Commission (OPSC) about their investigation into the ongoing DNA backlog crisis that continues to hinder many cases, leaving victims and their families going years without justice.
“More than 80 murders are recorded in South Africa every day, but only 14,5% of them are solved. One of the reasons that the conviction rate is so shockingly low, is because of massive DNA processing backlogs,” says Ian Cameron, Director of Community Safety at Action Society.
Liezel de Jager was murdered more than 775 days ago. Mia Botha was found dead 496 days ago. Cleo Diko died 370 days ago and Chevonne Rusch was killed more than 631 days ago. Alfredo April more than 217 days ago. In many of these cases, forensic neglect is making an arrest impossible. In others, the backlogs cause delay upon delay in court. In some cases the forensic evidence is so poorly handled or tested, that it is useless and no perpetrators can be identified.
“DNA evidence is by far the most effective crime fighting tool, but despite the president proclaiming war against GBV on many occasions, the government and especially the SAPS are not taking any real action in sorting out the DNA backlog. Thousands of victims of rape and violent crime, as well as families of murder victims, are not getting their day in court. Action Society believes this has become a human rights violation which undermines South Africans’ constitutionally entrenched rights to equality, fair administrative action, as well as access to courts.”
Background on Action Society’s complaint at the OPP:
Despite all the work to ensure the formation of a DNA database against which new samples could be compared, all DNA testing at the FSL ground to a halt in 2020 because Bheki Cele failed to pay the agreed fees for the PCEM system in June 2020, causing the subsequent shut down of the system. This caused a backlog in forensic testing in over 125 000 cases, of which 92% were sexual assault kits. In November 2020, Cele admitted that the DNA backlog was a whopping 117 738 cases. By December, this figure had grown to 142 504. In March 2021, the FSL head, Major General Edward Ngokha, confirmed that the backlog stood at 172 787 and that nothing had been processed for in January or February. Action Society learned through a PAIA application that the backlog stood at 241 152 in April 2021. By July 2021, a backlog of more than 300 000 cases led to Action Society’s complaint with the PP in October 2021.

SA's population swells to 62 million - 2022 census at a glance
In the last decade, the population in South Africa has increased by around 10 million people, with a total of 62 million people living in the country, according to the 2022 census.
Statistics South Africa released the fourth democratic census on Tuesday. The last census was published in 2011.
According to the data, there are 62 027 503 people in South Africa compared to the 2011 census, which recorded 51 770 560 people. This translated to a population growth rate of about 18%.
Compared to the first democratic census published in the '90s, the population increased by more than 20 million people from 40 583 573 recorded in 1996.
The census also showed that there are more than 2.4 million international migrants in the country, which equates to around 3% of the total population.
Most of the international migrants come from the SADC region. Around 45.5% of international migrants come from Zimbabwe, 18.7% from Mozambique, and 10.2% from Lesotho.
Population composition
Black Africans remained the dominant population group, accounting for 81.4% of the population, which translates to around 50.4 million.
The black African population increased by around 9 million compared to the 2011 census, which recorded around 41 million black people.
The coloured population accounted for 8.2% or around 5 million people, followed by white people at 7.3% or 4.5 million people.
According to the data, the white population has steadily declined from 11% of the total population in 1996 to 8.9% in 2011 and then 7.3% in 2022.
The Indian and Asian population accounts for 2.7% of the total population.
Women constituted 51.1% of the population, while men accounted for 48.5%.
Population distribution by languages spoken at home
IsiZulu remains the language most spoken at home, accounting for 24.4%, followed by isiXhosa at 16.3%, Afrikaans at 10.6% and Sepedi at 10%.
Around 8.7% of the population speak English at home.
IsiZulu speakers increased by 1.7% compared to 2011, while isiXhosa speakers increased by 0.3% and Afrikaans speakers decreased by 2.9%.
Religion
The majority of the population reported that they were Christians (85.3%) followed by traditional African religions (7.8%).
Around 1.6% of the population subscribed to Islam, while 2.9% said they had no religious affiliation.
Population by province
Gauteng and KwaZulu-Natal remained the most populated provinces, with 15 million and 12.4 million people living there, respectively. The Western Cape has a population of around 7.4 million.
The Northern Cape has the smallest population of around 1.3 million people.
In terms of internal migration, Gauteng dominated, receiving more than a third of all internal migrants, followed by the Western Cape with 15%.
In the last decade, KwaZulu-Natal, Limpopo, the Eastern Cape and the Free State experienced an outflow of people.
Access to basic services
The census 2022 recorded an upward trend to access to basic services from 2001 to 2022.
In 2022, more than 80% of households in the country have access to piped water, either inside their dwellings or inside their yards.
More than 90% of households have access to electricity for lighting, an increase from the 58% recorded in 2011.
Collation of data
The 2022 census was the first-ever digital census conducted in South Africa.
The information was collected via a digital questionnaire using three different modes of collection, including computed assisted personal interviews where field workers visited households and conducted the interview with a handheld device.
In addition, telephone interviews were conducted, and the public was also able to complete the questionnaire over the internet.
The collection of the population and housing data started on 2 February 2022 and ended in May 2022.
Statistics SA received more than 20 million questionnaires from households, which formed the basis of the population and housing statistics.

Services on the Passenger Rail Agency’s (Prasa) Shosholoza Meyl have been suspended, one month after the long-distance train was relaunched following a two-year hiatus.
A Joburg resident recently complained that he attempted to book a compartment on the train for February but was informed by Prasa that the service was suspended due to a lack of locomotives and that it would only resume once the locomotives had been replaced.
This comes despite the agency announcing in December that it had “received additional locomotives from Transnet to address the impact of unreliable old locomotives that disrupt some of the trips on the recently reintroduced Mainline Passenger Services (MLPS).”
“Service” is a big word
In a CapeTalk interview, railway expert David Williams said that the MLPS was not resumed in full; rather there was one train per week running between Joburg and Cape Town, and Joburg and Durban, respectively.
“The answer [to whether South Africa has a long-distance train service] is it does not,” said Williams.
“In fact, service is a very big word for what they did, what they did was they ran one train per week from Johannesburg to Cape Town and to Durban, and in both cases, there were big problems along the way.”
For example, the train from Joburg to Durban took 30 hours to complete the route, twice the estimated time of 15 hours, as there were “complications” on the line, according to Prasa.
Additionally, the first Cape Town trip ended at Wellington 70km short of its final destination due to stolen overhead cables, and the second Cape Town trip ended at De Aar due to a shortage of locomotives. In both instances, the journey was completed by bus.
Many of these issues stem from the fact that Prasa and Transnet share unequal ownership of the country’s rail network and report to different government departments – Prasa to the Department of Transport and Transnet to the Department of Public Enterprises – creating a perfect formula for bureaucracy and miscommunication.
Furthermore, most of the rail infrastructure in the country is maintained by Transnet, meaning Prasa has little control or oversight of the tracks it must use.
Prasa also does not have enough locomotives to support the MLPS by itself so it must source them from the freight rail entity – a process that has been anything but smooth.
“What’s not clear is why [Transnet] couldn’t provide one locomotive, or two locomotives, for the train that was held up at De Aar,” said Williams.
“Is Transnet Freight Rail not running any trains to Cape Town at the moment?”
Big question marks are therefore hanging over the supposed “relaunch” of the Shosholoza Meyl and what the real reason was behind it, given that it was clearly not ready for public service.
“I think there has been a lot of pretending by the government, they don’t realise how much has to be made up to restore [the MLPS] as there are big issues,” said Williams.
“We are a very long way to restoring this long-distance service between cities.”
