On March 4th 2022, while out on a photography shoot, I was detained and searched due to a call of Suspicious Picture taking. Open carry of a firearm is illegal in all but a few circumstances in California and generally a misdemeanor offence like it or not. Since lawsuits are pending to overturn the unconstitutional laws on open carry here in California, they are still enforceable laws. Keep in mind that by the law, OCSD had a legal right to detain me temporarily until the moment the possible firearm was identified as a taser. The open carry of a taser is legal and lawful in California. Case law is clear that being a felon is NOT a default status in the USA and I do take issue that he did not release me from the detainment until he ran me for warrants and checked if I was a felon. After all, he did not suspect me of being a felon, he just wanted to make sure I was not one. In my opinion, he could have, and most likely did realize my taser was just that by briefly looking at it and immediately re-holstered it and said his goodbyes. But no... CASE LAW - The open carry of a possible firearm is RAS of a crime, and under Terry v. Ohio, an officer MAY do pat downs/search for weapons and stated - "A reasonably prudent man would have been warranted in believing [Terry] was armed and thus presented a threat to the officer's safety while he was investigating his suspicious behavior." The Court found that the searches undertaken were limited in scope and designed to protect the officer's safety incident to the investigation." Again, when it comes to "officer safety" the 4th Amendment is a "paper tiger" and in cases may be null and void.
