He needed to use the restroom and realized he will be unable to make it to the next rest area before he does so because parking a semi is no easy task and he did not want to get stuck on some random exit ramp. As he pulls off the side of the ramp, the load in his trailer shifts and the truck tips over about 45 degrees. The Truck is fine, but the trailer is damaged beyond repair. Police are called by about 9 or 10 different people, but the the Perkins' (who testify in this trial) are the only ones to actually witness the incident. When police arrive, they interact with Mr. Darnell for about an hour and 45 minutes before the deputy suddenly realizes that he thinks he smells alcohol, and decides, "Hey, a free DUI!" So he begins to perform field sobriety tests and arrests Mr. Darnell with little to no investigation. Mr. Darnell explains to the deputy that he drank AFTER he drove NOT during, or BEFORE, but the deputy just doesn't care to listen -- all he hears is, presumably, his supervisor's compliments on getting a +1 on the DUI arrest sheet. We take the case to trial. The jury is smart and realizes that the cop had no business arresting Mr. Darnell for a DUI. So they acquitted him of that. Unfortunately, they do not quite understand that a semi has a legal right to carry alcohol, so long as it is in the back, so they convict Mr. Darnell of that offense.
