Texas Tests Its “Merry Christmas” Law
Good evening, I’m still reporting on the Texas “Merry Christmas” law.
A Texas school board will discuss tonight the fate of a Charlie Brown Christmas poster that a school staffer decorated her door with, and 2 days later, the school’s principal made her remove.
Dedra Shannon, a clinic aide at Patterson Middle School in Kileen, Texas put up the poster which features a screenshot of the popular Christmas television special “A Charlie Brown Christmas.”
At the bottom of the poster was a verse that is recited by the character “Linus”:
“For unto you is born this day in the city of David a Savior which is Christ the Lord. That’s what Christmas is all about, Charlie Brown.”
School principal Kara Trevino told Ms. Shannon that she could leave the Charlie Brown characters up, as long as she removed the bottom portion of the poster that contained the Bible verse. According to Ms. Shannon, Trevino said that it:
“… is an issue of separation of church and state. She said the poster had to come down because it might offend kids from other religions or those who do not have a religion.”
Well, this is a common misconception. The “wall of separation between church and state” is nowhere spoken of in the U.S. Constitution. It only existed in one letter from Thomas Jefferson to the Danbury Baptists on Jan. 1, 1802.
Therein Jefferson reassured the Baptists – who had been persecuted at the hands of government from the 1630s to the time of the federal Constitution in the 1780s – that persecution by the government would come to an end thanks to the First Amendment to the Constitution which guarantees “the free exercise of religion.”
The founding fathers never intended that the Constitution protect the government from the influences of religion. It was made to protect religion from intrusions and persecutions by government.
So, the Texas legislature passed a state law reaffirming this original understanding and it became effective in 2013, called the “Merry Christmas” law.
It protects school workers from government interference from displaying their religious beliefs as an attack on religious liberty and a violation of the First Amendment and state law.
One of the legislators who voted for the “Merry Christmas” law is now the Texas Attorney General, Ken Paxton.
“We passed that law precisely because of this type of discrimination against people of faith.”
“I’m calling on the school board … to immediately reverse their unlawful decision.”
The school board will discuss the issue this evening.
