Second Amendment Sanctuaries: How States Nullify Federal Gun Control

It dates back to 1798, when the legislatures of Kentucky and Virginia supported resolutions that asserted the states’ right to stand against federal infringements on their powers. During the 1850s, Northern states resisted the Fugitive Slave Act of 1850. For Second Amendment activists attempting to roll back federal overreach on the right to bear arms, this strategy is slowly becoming an attractive option.

During the Obama Administration (2008-2016), Republicans in various state legislatures put forward dozens of nullification bills. By the end of his eight-year term, 22 states had 50 bills pushing back against encroachments on the Second Amendment and governors signed five bills into law taking on federal gun control.

Anyone familiar with the Bible is familiar with the Mark of the Beast: Without this mark, no man may buy or sell.
Regardless of one’s religious faith or lack thereof, there is an illustrative case in this biblical story: When one cannot buy or sell, one is metaphorically up the creek. Short of producing everything one needs oneself, buying and selling are necessary parts of virtually every modern person’s life.
In our modern world, we can begin to see a sort of Mark of the Beast: While ideas and even objects aren’t banned, they are increasingly difficult to come by, not due to government fiat, but due to the machinations of corporations hostile to the American values of freedom.
One can be in favor of the free market while recognizing a simple truth: There is no way that America’s Founding Fathers would have sat on their hands while five corporations dominated American discourse and commerce. It is hard to imagine, for example, the Founders suffering a single private bank processing most of the payments in the United States and refusing to do business with gun merchants. Alternately, one can scarcely imagine that the Founders would have sat still for three companies – all of them hostile toward American values and the Constitution – dominating political discourse and deplatforming anyone who opposed them.
This is the situation in which we find ourselves as a nation today: Guns are not illegal, but private companies will make it increasingly difficult to buy, sell or own them – up to and including pulling your bank account. You have all the freedom of speech you like, but prepare to be deplatformed or have your voice buried by large tech corporations with their thumb on the scale of American discourse.
As the American economy has become more corporatist – such that the market is controlled by the interrelation between monolithic mega-corporations, Wall Street and the state – and less capitalistic and dynamic, the American press and economy are now being dominated by forces hostile toward the American public and American values.

Signed by President Franklin D. Roosevelt on September 2, 1937, the Pittman-Robertson Act, known officially as the Federal Aid in Wildlife Restoration Act of 1937, does not establish a new tax. Instead, it commandeered an existing 11-percent excise tax on rifles, shotguns and ammunition, and a 10-percent tax on pistols. Rather than going into the general fund of the United States Treasury, the Pittman-Robertson Act earmarked this money for the Department of the Interior and its wildlife preservations efforts. The money is then distributed to the states and can be spent how they see fit.
This was a coup for the Second Amendment and liberty movements. Rather than the money going toward a federal government interested in stripping them of their rights, it went to the Department of the Interior, with interests in keeping the American wilderness wild at heart. With this bill, hunters and firearms enthusiasts continued their role as the unsung heroes of the American conservation movement. In fact, Federal Ammunition was instrumental in getting the bill made into law.

"Freedom" is predominantly an internal construct. Viktor Frankl, the legendary Holocaust survivor who wrote Man's Search For Meaning, said it well: “Everything can be taken from a man but one thing: the last of the human freedoms – to choose one’s attitude in any given set of circumstances, to choose one’s own way (in how he approaches his circumstances).”
In other words, to be free is to take ownership of what goes on between your ears, to be autonomous in thoughts first and actions second. Your freedom to act a certain way can be taken away from you – but your attitude about your circumstances cannot – making one's freedom predominantly an internal construct.
On the other hand, "liberty" is predominantly an external construct. It's the state of being free within society from oppressive restrictions imposed by authority on one's way of life, behavior, or political views. The ancient Stoics knew this (more on that in a minute). So did the Founding Fathers, who wisely noted the distinction between negative and positive liberties, and codified that difference in the U.S. Constitution and Bill of Rights.
The distinction between negative and positive liberties is particularly important, because an understanding of each helps us understand these seminal American documents (plus it explains why so many other countries have copied them). The Bill of Rights is a charter of negative liberties – it says what the state cannot do to you. However, it does not say what the state must do on your behalf. This would be a positive liberty, an obligation imposed upon you by the state.

The siege of the Branch Davidian compound in Waco, Texas, is an important event in American history because it directly led to one of the biggest terrorist attacks on American soil – the bombing of the Oklahoma City Federal Building. It’s not necessary to defend this act of terrorism to understand why the entire freedom movement of the time was so incensed by it. Indeed, it stood as a symbol of federal overreach and the corruption of the Clinton Administration.
It’s important to separate fact from fiction when it comes to the siege of Waco, just as it is important to do so with the siege of Ruby Ridge or the attack on the American consulate in Benghazi. With every event, it is important to stick to the facts and what can be extrapolated from them to make the strongest argument about what went wrong and why, and what could be done differently in the future.
Molly and Sam talk about what led up to the incident at Mount Carmel and how the siege began, as well as the tragic ending that resulted in over 80 deaths, 20 of which were children. They share their opinions on David Koresh, the ATF, overreach of the federal government, and what, if anything, could have prevented this massacre. Known as the 9mm Luger to some, the 9x19mm Parabellum cartridge is the most popular ammunition cartridge for handguns in the world – with more than 60% of the world's law enforcement agencies currently using this cartridge. The 9mm semi-automatic Luger was used as the standard issue handgun during World War II for many national militaries, and the ongoing popularity of this ammo testifies to its capabilities as a pistol cartridge.
NATO adopted the 9mm in 1955 as their official sidearm cartridge. And 30 years later, the U.S. Military exchanged the venerable .45 ACP for the 9mm as their official cartridge. Many people debate this decision still, yet less than 10 years later, shooters were able to find the caliber in almost every gun store.
Georg Luger developed the cartridge and began selling it for the DWM Luger semi-automatic pistol in 1902. The cartridge is compact, allowing shooters to carry quite a bit of it without the burden of excessive weight. For this reason, many civilian gun owners and police agencies have moved away from other handguns, and now favor 9mm semi-automatic handguns. Ammunition availability has followed this trend – with cartridges more plentiful and easier to find than other calibers. The FBI even switched to it before they started using the more modern 10mm cartridges.
While not the most powerful, this ammunition allows for better control and follow-up shots, which helps novice shooters who are unable to effectively deal with larger cartridges. Depending on your level of skill and experience, you may want to speak with a salesperson about the best 9mm cartridge for your needs.
Though the cartridge does not have as much stopping power as the .45 ACP, it remains a great choice for many shooters due to being lightweight and compact. Used in conflict resolution around the planet, the 9mm has also been used by hunters. Modern JHP loads serve well in hunting applications, and you can usually find them easily.

The case of MOVE is an unusual one, because they cannot simply be shoe-horned into the usual “they were just minding their own business and then the cops came in with overwhelming force” narrative that more or less applies at Ruby Ridge or at Waco. This is not to imply that the actions taken by the Philadelphia Police Department were appropriate – there were children inside the MOVE townhouse. However, it is important to note that MOVE had a history of violence.
If nothing else, the bombing of the MOVE house in Philadelphia is an excellent example of a complicated situation with no easy answer. This is precisely what makes it worth close examination by those interested in government overreach and Second Amendment rights.
