A Madison doctor who pleaded guilty in November to health care fraud was sentenced to four years in federal prison and with one of his co-conspirators must pay more than $7.2 million in restitution.

Dr. Shahjahan Sultan, who formerly practiced in Vicksburg, was one of four people accused in a multi-million dollar health care fraud involving expensive compounded pain creams and weight-loss pills.

According to Sultan's attorney, former state Supreme Court Justice Chuck McRae, at least $4 million has already been repaid.

Sultan stood before U.S. District Judge Keith Starrett on Tuesday at William M. Colmer Federal Courthouse and apologized for his actions — not just to the judge, but to everyone who was affected by the fraud.

"I was an idiot, pardon my harsh language," he said. "This has been a monkey on my back. I want this all to go away, but it never goes away."

Are you the same guy on the Michael Santos Earning Freedom podcast? I listen to his podcasts from time to time and caught your show. I was curious on how you were able to go from 42 months to 13 months in prison with RDAP and Good Time Credits. I was under the understanding that with 42 months, you were looking at 12 months off your sentence for RDAP, roughly 6 months off for "Good Time" credit and then "an increase to the full 6-months halfway house/home confinement". How were you able to get 11 months of HWH/HC? I am waiting for my plea and sentencing date. I signed my plea deal back in May of 2015 and for whatever reason, I am waiting for my plea and sentencing date. I committed a white collar crime (wire fraud) and I am looking at either 27 months or 33 months at a maximum (assuming that I don't piss the Judge off). The reason for the difference is that we did not agree on the 2-level sentence enhancement for "Abuse of Power/Trust" that the AUSA wants to hit me with and we will leave it to the Judge to decide if the enhancement is valid or if it's double jeopardy. The AUSA has agreed to seek the minimum of either sentencing range so they are arguing 27 or 33. CARES ACT | Home Confinement | COVID- 19 & the BOP dropping the ball Sentence reduction (compassionate release) (1) Brief History: (a) So which is it? Sentence reduction, compassionate release or CARES ACT? (b) Where sentence reduction authority is found (18 USC 3582(c)) (c) Background -The courts have always had the power to reduce sentences when judges found circumstances for doing so, but until First Step Act, only the BOP could do file a motion to start a sentence reduction proceeding; (2) Grounds for sentence reduction: (a) extraordinary and compelling reasons warrant the reduction; or (b) the defendant is at least 70 years old, was convicted of a violent crime, and has served at least 30 years in prison; (3) What is “extraordinary and compelling?” -The Guidelines define an “extraordinary and compelling” reason to be (a) The defendant is suffering from a terminal illness; (b) The defendant is suffering from a serious physical, medical, aging, or mental condition, that substantially diminishes his or her ability to care for self in prison; (c) The defendant is at least 65 years old; is experiencing a serious deterioration in physical or mental health because of the aging process; and has served at least 10 years or 75 percent of his or her term of imprisonment,; (d) The defendant’s minor kids have lost their caregiver due to death or incapacitation; (e) The defendant’s spouse has become incapacitated, and defendant is the only available caregiver; (f) There is some other extraordinary and compelling reason 2 (4) Once you have “extraordinary and compelling,” is that enough? – If the defendant has an extraordinary reason, he or she still has to show (a) he or she is no danger to anyone else or the community; and (b) a sentence reduction would not offend the sentencing factors in Section 3553(a) of Title 18 (1) the nature and circumstances of the offense and the history and characteristics of the defendant; (2) the need for the sentence imposed to reflect the seriousness of the offense, to promote respect for the law, and to provide just punishment for the offense; to afford adequate deterrence to criminal conduct; to protect the public from further crimes of the defendant; and (3) the need to avoid unwarranted sentence disparities among defendants with similar records who have been found guilty of similar conduct; and (4) the need to provide restitution to any victims of the offense. As we all know by now, RDAP is one of the few ways to reduce an sentence by up to 12 months. There are a few things that a person can do prior to sentencing which can greatly increase the odds of acceptance into the program. Irving Schattner is a licensed clinical social worker with more than 25 years experience. Unfortunately, due to the nature of addiction, offenders are often in a state of denial about their substance abuse and minimize or omit valuable information which can be included in the Report and presented before a judge. When included in the PSR, it may be lacking or insufficient in detail to support a recommendation by the judge of admission to the Program. Wanting to paint a positive picture of their client (“Boy Scout complex”), attorneys may even de-emphasize their client’s substance abuse problem in the belief that if such documentation is introduced the sentencing judge will look less favorably on their client. Updating the PSR, after the fact, is very difficult after sentencing. In such cases, the burden of proof is much higher but not impossible. If the PSR is not updated, there is another option for getting into RDAP, including an assessment and report from a mental health professional documenting the presence of alcohol / and or drug abuse in the 12 months prior to indictment or arrest. As a clinical social worker in private practice, I have successfully worked with substance abusing offenders, prison consultants and attorneys in conducting assessments, counseling and diagnostic report writing, to gain admission into the Federal Bureau of Prison’s (BOP) Residential Drug Abuse Program (RDAP).
