(CNN)Former Minneapolis police officer J. Alexander Kueng laughed at a joke made by Derek Chauvin while restraining George Floyd. according to testimony Thursday. Citing body camera video transcripts. Assistant US Attorney Manda Sertich asked Kueng during cross examination what he was laughing at on video. Kueng told the jury that a few days earlier. he and Chauvin had responded to an incident at a hospital involving a patient who was restrained and yelling that he could not breathe. After a nurse had said. 'it takes a lot of oxygen.' Chauvin said that he would use that line. Kueng referred to it as 'a brief moment of levity.' Kueng is one of three officers including Tou Thao and Thomas Lane standing trial in federal court for violating Floyd's civil rights. All three are each charged with deprivation of rights under color of law while Chauvin restrained Floyd. Thao and Kueng are also charged with willfully failing to intervene in Chauvin's use of unreasonable force. resulting in Floyd's death. The three have pleaded not guilty to the federal charges and are being tried together. Chauvin admitted guilt in December as part of a plea deal. All three former officers will face a state trial later this year on charges of aiding and abetting in Floyd's murder. Sertich asked Kueng about the moments leading up to Floyd's restraint and about his recollection of Floyd on the ground. While displaying a Minneapolis Police Department training document titled 'Conscious Neck Restraint.' Kueng said he had not been trained or aware of the 'technique using the leg.' 'The senior officer must have been trained in it at some point.' Kueng continued. referring to Chauvin pressing his knee on Floyd's neck. Sertich then attempted to show a portion of Thao's bodycam video showing the scene about one minute into Floyd's restraint. Kueng's defense attorney. Thomas Plunkett. objected to the use of bodycam audio. claiming it showed a perspective Kueng was not aware of at the time. 'Yes. at some point.' he replied. adding that Lane had said Floyd was passing out. Kueng defined it as a medical concern. but not a 'serious medical need.' as Sertich referred to it. Sertich asked if it's fair to say that Kueng could have performed CPR in his position while on the ground. Kueng agreed. saying that they could have uncuffed him and secured the scene. He added that the paramedic seemed 'quite casual' when he arrived. Kueng testified he had little experience handling large individuals resisting arrest before the fatal encounter with Floyd. Citing a December 2019 call for service involving an intoxicated person striking people at a bar. Sertich asked Kueng if the man continued to resist arrest after being

Judge in Sarah Palin's defamation suit against New York Times says he will dismiss case
New York (CNN Business)Judge Jed Rakoff. the judge overseeing former Alaska Gov. Sarah Palin's defamation lawsuit against the New York Times. said Monday afternoon that he will dismiss the suit. ruling that Palin's team did not prove a key element of its case. Rakoff's ruling came while the jury is deliberating over a verdict and Rakoff said he will allow the jury to continue deliberating and to reach a verdict. and will dismiss the case once it has done so. Rakoff presented his findings a clear round one win for The Times with an eye toward an inevitable appeals process. The judge said Palin did not prove 'actual malice.' which is the standard her legal team had to meet in her defamation case. The landmark 1964 New York Times vs. Sullivan case specifies that public figures who sue for defamation must prove that the offender knew the claim was false or showed 'reckless disregard' for the truth. The Times said all along that it made an honest error involving Palin — and issued a swift correction. Palin argued that the publication smeared her on purpose. Rakoff sided with The Times after hours of discussion about the publication's motion that the Palin camp had not presented a 'legally sufficient evidentiary basis' for the case. 'I think this [was] an example of very unfortunate editorializing on the part of the Times.' Rakoff said in court Monday. 'The law here sets...

Here's What A Train Sees When It Splits A Car In Two
A private train line cut a small car in two Wednesday morning after the driver maneuvered around the safety gate and into the path of an oncoming train in Lake Worth Beach. Florida. It’s the third such incident in four days for the rail line. Brightline. a private train company running routes between Miami and West Palm Beach. asked people to please be more mindful of the huge train barreling down the tracks: The driver in this case was identified as Luis Maniel Paez of Miami. WPBF reports. Paez is in serious condition at a local hospital. We’ve said it before. we will say it again (and again): It’s definitely not a good idea to mess with trains. They are bigger and faster than you and cannot stop immediately. You might think you can beat them across the tracks. but it very much is not worth the risk. Unfortunately. this isn’t the only crash Brightline has experienced this week. Tuesday saw two crashes. both in Broward County. A train killed a pedestrian in Hallandale Beach. Florida. and a car with a mother and child inside was hit in Delray Beach. Florida after becoming stranded on the tracks. Last year 577 people were killed at train crossings. according to the Federal Railway Administration. with Florida being number two in the nation with 43 deaths. Whatever you’re doing Florida. knock it off. at least before Brightline puts in its latest connection in Orlando. The only state where more people died at train crossings was Texas at 51 deaths. It’s never good to be second to Texas in anything. You want to be a distant third. always.

Youngkin signs school mask mandate ban into law
Calling it “a win for all Virginians.” Gov. Glenn Youngkin on Wednesday signed into law a long promised ban on mask mandates in the commonwealth’s schools. The bill. SB739. allows parents to “elect for [their] child to not wear a mask while on school property.” regardless of any COVID 19 protection mandates passed by local school boards or issued by state agencies. At the signing ceremony in Richmond. Youngkin said of the move. “We are reaffirming the rights that we know all parents have.” citing “parents’ rights to make decisions for their children.” Also speaking at the signing ceremony. student Breonna McAllister said that though “My teacher been there to help … it is hard to breathe in [a] mask. It’s hard to hear my teacher and it has been hard to connect and make friends.” The bill passed the Virginia Senate on a bipartisan 21 19 vote last week and a party line 52 48 vote in the House on Monday. Under regular rules. the bill wouldn’t go into effect until July 1. but the General Assembly passed a Youngkin amendment that lets the law go into effect immediately. and gives school districts until March 1 to comply. ‘That’s what Virginia is all about’ In an interview with Fox News. Youngkin noted that Democrats were key to the bill’s passage and that he was pleased to see it draw bipartisan support. “If you choose your child shouldn’t wear a mask. you can make that decision. and if you want your child to wear a mask. you can make that decision as well. And that’s what Virginia is all about.” he said. Sen. Siobhan Dunnavant. a Republican and a key supporter of the ban. began her remarks at the signing by telling the crowd of parents. children and lawmakers. “I want to start by saying how wonderful it is to see your beautiful faces.” She said “It is time to stop putting kids last” and claimed. “Decisions about protecting yourself in health are never made well globally. because we’re all different.” “Parents make the decisions for their children; the political entities need to get out.” the senator said. “Parents … you talk to your doctors all the time; you can read what the recommendations are. and you can look at the complexity of your child and decide what’s right.” The Centers for Disease Control and Prevention recommends universal masking in schools. Challenges The constitutionality of the bill has been challenged in court. since it takes away powers that have been traditionally given to locally elected school boards. There was a brief discussion Wednesday on the House of Delegates floor about whether it’s constitutional to enact legislation on an emergency basis by a simple majority vote. Typically it requires a 4/5th superma

‘The Sopranos’ siblings steal Super Bowl commercial glory with Chevy ad —and lingering questions
Chevy has set social media alight with a Super Bowl ad that sees “The Sopranos” siblings reunite for the first time in almost 15 years. Actors Jamie Lynn Sigler. 40. and Robert Iler. 36. reprised their roles as Meadow and A.J. Soprano in the 60 second commercial. which aired during the second quarter of Sunday evening’s game. “The Sopranos” showrunner David Chase directed the ambitious ad. which recreates the iconic opening of the original show and rewrites its famously ambiguous final episode. In the original series. the opening credit sequence sees protagonist Tony Soprano driving his Chevy Suburban from Manhattan to New Jersey as the song “Woke Up This Morning” by Alabama 3 plays in the background. In Sunday’s night Super Bowl ad. Sigler — playing Meadow — is now in the driver’s seat of a Chevy (although it’s a plush new Silverado). She traverses the same route her on screen dad. while “Woke Up This Morning” also plays in the background. The ad proves that the siblings weren’t killed off after the final episode of the show — as has been posited in the past. Fans of “The Sopranos” flocked to social media to share their exhilaration about the ad. “I mean nothing can top...
