She looked fantastic on camera and the cop testified that she blew a whopping ".165" on the Preliminary Breath Test (PBT). There was no proof (in fact, on video, they said it was ".156, 157... something like that..?" Making their determination suspect since they never preserved the number on their badge cams NOR ever photographed the number on the PBT (takes 2 seconds). At one point during the trial, the officer slips up and mentions the inadmissible PBT, on accident (I truly believe he didn't mean to). So, naturally, I jump on it IMMEDIATELY. I try to convince the judge we can talk about it but the number can't get in, WHICH IS THE LAW. She declines to acquiesce, and forces an "all or nothing" situation. ... So, I go for broke.
