Emma hosts Joanna Schwartz, professor at UCLA Law School, to discuss her recent book Shielded: How The Police Became Untouchable. Professor Schwartz zooms out to look at the history of qualified immunity, beginning with the passage of the Klu Klux Klan Act in 1871 which sought to grant the right of trial and due process to the recently freed Black population when it came to addressing justice for constitutional violations by the state, only for the Supreme Court to respond immediately by making various decisions to undermine and stunt these developments as the US continued into the Jim Crow era. Moving into the second half of the 20th Century, Joanna and Emma explore the Supreme Court’s decision to finally reverse this decision in 1968, then opening up lawsuits against local governments in ’71, only to – once again – launch various decisions that undermined this right, opening up local governments to passing qualified immunity and other measures that protect them from accountability and hinder victims of police brutalities’ quests for justice. Wrapping up the interview, they tackle the history and development of policing institutions in the US, coming out of the slave economy and settler-colonial structure of the early US, and discuss what policy measures can help bolster Americans’ right to justice in the face of state abuses. Sam Mellins then joins as he walks through Kathy Hochul’s failed nomination of Hector LaSalle to the Chief Judgeship of the NY Court of Appeals, why she embraced this loss so dearly, and where it leaves the future of this seat.

Joanna Schwartz is a law professor at UCLA and the book is called Shielded How the Police Became Untouchable. Joanna thanks so much for coming on. Thanks so much for having me. of course. So you open your book in Atlanta in the introduction. And that's been in the news for cop-related police-related reasons recently because of the construction of Cop City, the demonstrations, and the protest against it. And you tell the story of Henry Norris who was a 78-year-old grandfather who had this encounter with police. It was not a lethal encounter, right? But still a horrifying one. Why did you make the choice to start with that story as opposed to you know some of the more well-known Infamous stories of police brutality in this country? And that is for a reason. The cases that Garner National and international attention are cases where there's a lot of public pressure to get Justice for the victims of misconduct. And in those cases often justice of some sort is quickly given to the victims and their families. But the kinds of cases that I'm really focused on are the cases that don't get public attention. and those really are the cases where the various kinds of barriers that the Supreme Court and state and local governments have created make it very difficult for those people to seek Justice. And so I start the story with one of those people his name is Andre Norris as you mentioned. He was sitting at home watching the news as he did most nights when a group of over a dozen police officers stormed into his home they were looking for a drug dealer and had a warrant for a house that was 30 yards away and looked nothing like his home. But they came into his home anyway, busted down the doors, handcuffed him, put him to the floor, and ignored his calls for help. He had heart trouble and he was twice the age of the person they were looking for but was mistreated nonetheless. and when he wanted Justice through the system there was no chance that the officers were going to be prosecuted. They weren't disciplined by the department.

He met with John Cornyn and encouraged him to speak with Democrats to find a compromise on legislation. and somehow Joe Biden is buying this. and he is supposedly waiting for what he calls rational republicans. we have the tweet. just one second. this first off again. Again. The democrats can't seem to understand this concept. the democratic leadership. yeah, there's a story in business side insider. and I get it republicans are the problem. don't email me. because we're talking about the Democratic leadership not getting that. send your emails to them. yes, democrats have majorities in a very slim one to be fair but in the senate and the house as well as the presidency. so blaming republicans right now well. no I mean look joe Manchin's not going to do it I get it but the best that Democrats can do at this point is to be engaged in politics about it.

Blair LM Kelley, jumps right into the absurd presentation of the working class in US politics, with a consistent focus on rural and suburban white populations despite the long and intricate history of a Black and POC working class in the US. First, Kelley steps back and parses through her own family’s history as members of the Black working class in the US, exploring how they were barred from working the jobs that they were skilled in or that allowed them any economic or social freedom – a practice deeply embedded in the US’ history well after the Civil War – before stepping back to analyze how this systemic deskilling of African Americans alongside the social segregation worked to shape the stereotypes of Black Americans as dependent on the government, despite the constant reality of Black Americans paying the same taxes and receiving drastically fewer benefits. Skipping a couple of centuries forward, Kelley then walks Emma through the role of the COVID-19 pandemic, and the designation of “essential” workers, in bringing the problem of proper compensation and fair working conditions for Black and POC Americans back to the fore. Next, Kelley looks at the industry of domestic labor as a central institution in the stunting of labor rights and conditions for Black and POC Americans – particularly women – before wrapping up with the myth of the “Working Class Trump Voter” and the intense intersection between labor and citizenship in the topic at hand.

We all know that @The Rubin Report is not funny. Dave Rubin is also not funny. If it weren't for the destruction that his politics leave in his wake, we would almost feel bad for him. But we don't feel bad for him, and in this clip we watch Rubin do a fake "hot mic/live camera" moment, during which he downs fake shots of tequila in order to fake cope with the fact that Gavin Newsom is still the governor of California and Larry Elder is still just a radio host. It's unclear why this would be funny even if it were real, as it insinuates that he doesn't care about a huge political story in the state he lives in? Anyway, it's sad.

Here is Scott Pruitt. He was Oklahoma I think head of the state EPA in Oklahoma if I remember correctly. Yeah. When Donald Trump appointed him to the federal EPA. he claimed his claim to fame when he was put into office, I should say on the federal level, was suing continuously the EPA so that he didn't have to follow environmental laws. That was what his job was and he was put there to deconstruct the administrative state at least on the EPA level. here he is with Newsmax's rob Schmidt celebrating EPA versus West Virginia. Rob thought about it. I mean from a legislative perspective if congress doesn't deal with these big issues. they can continue to blame what they can continue to blame the departments and agencies and administrative agencies that make these decisions. and never do it, never do the hard work of legislating. right. and the court is saying to congress you must do the job. you must pass the legislation to give the framework to the EPA. give the framework to all these administrative agencies .and you're right this is much bigger than the EPA. This is across the fear bureau, the pure bureaucracy, the deep state. the fourth branch of government as we know. The career bureaucrats and all these various agencies now have been sent a very clear message: you can't make it up. You know the clean power plan that the Obama administration passed. I led that effort along with other states to sue on that as I was attorney general instead of Oklahoma. Then when I went to the EPA I repealed it.
