Boris Johnson can still deliver a No Deal Brexit on the 31 October 2019.
There are at least 3 plausible options the Prime Minister has to remove the UK from the European Union on Brexit day without a deal in place.
The first option is to challenge the legality of the Hillary Benn Act which could probably be proved unconstitutional, since the question of Queens Consent wasn't raised at the third reading of the bill through the House of Commons.
The second option is argued by MP Bill Cash, in which he argues that since the Withdrawal Act has a commencement order, we are on target to leave on 31 October.
The third option raised by anti-Brexit barrister Jolyon Maugham is that Boris Johnson could secure a deal with the EU, get is passed by Parliament then simply fail to ratify it with the EU therefore leaving with No Deal, but having complied with the Hillary Benn Act.
