He had consumed one Dos Equis and the investigating officers never even went to confirm said fact with the establishment during their investigation, as is noted in the video. We had video of the stop that the prosecution disclosed only THREE DAYS before trial, after having told us that there is no video for nearly TWO YEARS. Two officers testified and so did my client. Luckily for us, the jury saw the truth through the testimony -- the officers did half a job and my client refused because the officers aggravated him after he blew into the hand-held breathalyzer outside EIGHT times (they wanted a higher reading, so they kept doing it over and over without clearing the chamber). Once he freed himself the officers were already on scene because some coon hunters (yes, we have those in Kentucky) who happened by, saw him stuck and called 911.
